1. Scope of Application

These Terms and Conditions of Sale (CGV) govern the contractual relationship between any customer (hereinafter “the Client”) and the Sauna de la Motta (hereinafter “the Provider”), concerning the purchase of wellness services (in particular sauna, cold bath, hot bath) offered on the website saunadelamotta.ch and on-site in Fribourg.

2. Services Offered

The Provider offers sauna sessions, cold and hot baths, and a relaxation area, according to the published schedule. Services are provided exclusively during the operational season as stated on the website.

3. Reservations

Reservations for groups of more than ten people can be made via email or phone.
Payment is made online or on-site (via credit card, Twint, etc.) at the time of booking.
All reservations are final and binding for the Client.

4. Payments

Only electronic payments (card, TWINT) are accepted. Cash payments are not accepted.

5. Cancellation and Refund Policy

Any cancellation by the Client must be made at least 24 hours before the booked time to be eligible for a full refund.
After this deadline, no refund can be claimed.
In case of cancellation by the Provider (extreme weather conditions, technical issues), a new booking or a refund will be offered.

6. Gift Vouchers

Gift vouchers purchased via saunadelamotta.ch or on-site are valid for 12 months from the date of purchase, within the operational period of the Sauna de la Motta.
Vouchers are non-refundable and non-exchangeable.
The Provider reserves the right to refuse any falsified or expired voucher.

7. Loyalty cards

Loyalty cards purchased via the website saunadelamotta.ch or on-site are valid for 12 months from the date of purchase, subject to the operating period of the Sauna de la Motta.

Loyalty cards are non-refundable and non-exchangeable.

They are non-personalised and transferable, provided that the person using the card belongs to the same pricing category. Otherwise, a person in the regular pricing category may use a loyalty card purchased at a reduced rate by paying a surcharge of CHF 7.– per entry.
Conversely, a person entitled to a reduced rate using a loyalty card purchased at the regular rate is not entitled to any refund, discount, or compensatory benefit.

8. Conditions of Use

Access to the sauna is prohibited for individuals under the influence of alcohol or with medical contraindications.
The minimum required age is 16, unless accompanied by a parent during the specified hours at which children are allowed.
The Client agrees to comply with all safety, hygiene, and on-site regulations.
The Provider reserves the right to exclude any person exhibiting inappropriate behavior, without refund.

9. Availability of Facilities

The provider makes every effort to ensure the availability of all facilities (saunas, baths, relaxation areas). However, certain facilities may occasionally be closed for cleaning, maintenance, or technical reasons.
In such cases, the client is not entitled to any refund or price reduction.

10. Liability

The Provider disclaims any liability for accidents or injuries resulting from improper use of the facilities.
The Client uses the facilities at their own risk. The Provider is not liable for accidents or injuries resulting from inappropriate use, failure to comply with safety instructions, or poor physical condition.
The Provider is not responsible for lost or stolen items.

11. Use of Images for Promotional Purposes

By entering the premises of Sauna de la Motta, the client acknowledges that staff may occasionally take general photos of the site or ambiance for promotional use (website, social media, etc.).
Such images will only be used if individuals are not recognisable and are photographed in a way that preserves their anonymity and decency.
No identifiable image of a client will be used without their explicit consent.

12. Data Protection

Personal data collected during booking is used solely for service execution and is not shared with third parties, unless legally required.

13. Intellectual Property

The content of saunadelamotta.ch (texts, images, logos, etc.) is protected by copyright. Any reproduction without authorization is prohibited.

14. Governing Law and Jurisdiction

These CGV are governed by Swiss law.
Jurisdiction is located in Fribourg (Switzerland).

15. Acceptance of the General Terms and Conditions

By purchasing an entry ticket or making a reservation, the client fully accepts these General Terms and Conditions.

16. Changes to the General Terms and Conditions

Sauna de la Motta reserves the right to modify these general terms and conditions at any time. Updated versions are published on the website saunadelamotta.ch and become effective upon publication.
